Translation Permission Addendum
- Operated by
- GATHWAY INC.
- Effective
- Version
- 1.0
No existing contributor is deemed to accept this Addendum through registration, earlier publication, membership, silence or a privacy acknowledgement.
1. Parties, original agreement and voluntary participation
This Addendum is between GATHWAY INC., operator of The Insight Docket, and the Rights Holder signing Schedule A. It supplements the Contributor Publishing Agreement identified there. It applies only to the identified work and the purposes affirmatively selected in Schedule A. Declining optional translation permission does not by itself affect an existing account, original publication, contributor status, subscription or monetization eligibility. Existing terms continue otherwise unchanged.
2. Defined scope and licence
Rights Holder grants GATHWAY a non-exclusive, worldwide, revocable licence for the identified whole work, including its chapters and versions created during the permission period, solely for the selected purposes below and solely on The Insight Docket website and its necessary technical delivery services. The initial target languages are English, French, Spanish and Portuguese; a direction is used only after the Platform's quality approval. Other languages, separate distribution channels, paid syndication, exclusivity, print and audiobook uses require further signed authorization. A registration preference does not grant these rights.
The four separately selectable purposes are:
- Private contributor previews: a translation requested by the contributor of their own identified work, including an unsaved draft preview. A preview does not save, submit, replace or publish the original.
- Confidential editorial review: authorized reviewers may translate the identified unpublished or published work to understand it, create a separate private working copy, add comments and suggest changes. This is not permission to publish the submission or translated copy.
- Reader-requested translation aids: after the original has independently been approved and published, a reader may request automated translation. Completed results may be cached and reused by other eligible readers, including eligible anonymous adults, under the approved privacy notice. This does not create an independently approved or indexed translated publication.
- Separately approved translated editions: human preparation/review and separate approval of an identified translated version for public publication and indexing, subject to section 5.
An unselected purpose is not permitted. This standard pilot form covers the whole work and all four listed languages. Do not use it for narrower chapter, revision, territory or language restrictions that the system cannot enforce; negotiate and implement the restriction first. Third-party/public-domain material needs a documented rights assessment rather than unsupported contributor consent.
3. Copyright, attribution and moral rights
Rights Holder retains copyright in the original. GATHWAY will keep the original manuscript, approved revisions, attribution and original URL separate from translated copies. Translation edits do not silently amend the source or its editorial history.
As between GATHWAY and Rights Holder, to the extent GATHWAY acquires transferable rights in automated output for the work, GATHWAY assigns those rights to Rights Holder subject to this limited licence. This is not a promise that AI output is copyrightable, unique or exclusive. A human translator's independently protectable contribution must be cleared under a separate written arrangement before publication; this Addendum cannot assign a third party's rights. GATHWAY will obtain the rights necessary for the agreed use or withhold the edition.
There is no blanket moral-rights waiver. Use the author's agreed name, pseudonym or anonymity choice and appropriate translator/reviewer credits. Material changes that could distort meaning require agreement. No new indemnity, revenue entitlement or monetary liability cap is introduced.
4. External AI processing and confidentiality
If external processing is expressly selected in Schedule A, Rights Holder authorizes GATHWAY to send necessary text sections and language instructions to OpenAI's business API under the provider arrangement, privacy notice and retention schedule identified there. GATHWAY will not activate a purpose before its contractual/privacy requirements and technical safeguards are cleared. It will not opt this material into model training or unrelated provider-improvement programmes.
Requests can contain personal information embedded in prose. Placeholders for some names, quotations and citations are not guaranteed anonymization. GATHWAY will not add account emails, identity documents, financial records, private application messages or unrelated manuscripts to a translation prompt. Unpublished submissions, editorial copies, comments and review history remain private to authorized personnel and approved processors; they do not become public caches or search results.
Permission from a copyright holder is not consent from every person described in a manuscript. Rights Holder must identify known third-party restrictions. GATHWAY must assess privacy authority and must not process sealed, privileged, embargoed, highly sensitive or otherwise uncleared material without the necessary authority and safeguards. Processing outside Canada may expose information to foreign legal processes; the approved notice must identify the actual arrangement. A materially different provider or purpose requires review and any additional notice/permission required by law or this Addendum.
5. Accuracy, source protection and publication approval
Automated translations can misstate legal, scientific, factual, cultural or literary meaning. Reader aids identify their automated origin, link to the original and disclose that protected quotations and reference blocks may remain untranslated. They are not professional advice or certified translations. Names and references must be checked; fabricated authorities or quotations are prohibited.
Editorial reviewers must compare material conclusions with the original or a qualified bilingual reviewer. Their copy/comments do not modify the original. Translation does not replace contributor approval, source publication approval or the Platform's editorial process.
A separately published translated edition requires clearance of its translation rights and human-translator contributions, affirmative author approval of the exact version, qualified bilingual review and separate authorized editorial/publication approval. Silence, a staff checkbox alone, membership or a generated result is not author approval. Author approval does not compel publication; the Super Admin retains existing authority. Preserve the version and approval evidence privately. Where these conditions are not satisfied, retain only a permitted private copy or reader aid and withhold separate publication/indexing.
6. Retention, withdrawal and correction
The accompanying Translation Processing and Retention Notice governs content lifecycle, holds and permitted financial/rights evidence. Rights Holder can report errors or withdraw future translation permission at legal@gathway.app. On verified withdrawal, GATHWAY will suspend affected new processing and Platform access, withdraw affected editions, and dispose of eligible translated content through the approved process. A later grant does not automatically republish a withdrawn edition. Original publication rights do not end by implication.
This translation licence ends on verified withdrawal; it does not automatically inherit the original's continuing public archive licence. GATHWAY may retain restricted minimal evidence and records justified by law, holds, disputes or financial obligations. No continuing public archive right in a withdrawn translation is granted by default. Independent search engines, delivered browser copies and third-party records cannot be guaranteed immediately erased; GATHWAY will take reasonable available removal steps.
7. Responsibility and existing commercial terms
Rights Holder confirms they control the selected permissions or are authorized to grant them and identifies known limitations. GATHWAY remains responsible for its processing, security and editorial obligations. Automated limitations do not waive mandatory consumer/privacy rights or liability that cannot lawfully be excluded. Existing dispute and complaints provisions continue. Fees, memberships, earnings, tax and monetization eligibility remain governed by existing separately accepted terms; this Addendum guarantees no translation, publication, readership or income.
Schedule A — execution record
