This text is proposed and is not in force. It is published for review by the Founder of GATHWAY INC. No user has been asked to accept or acknowledge it, and it does not change any agreement already in place. Passages marked [FOUNDER DECISION] are still to be decided.
The version in force is Terms of Use, Version 1.1, effective Oct 13, 2026.
1. Operator and scope
GATHWAY INC. (“GATHWAY”, “we”, “us”), a Canadian corporation, operates The Insight Docket (“Platform”) at theinsightdocket.com. Contact: legal@gathway.app; privacy@gathway.app for privacy requests. Registered office: 230-7737 Lundy’s Lane, Niagara Falls, Ontario, Canada.
These Terms apply to access to and use of the Platform by readers, account holders, contributors and visitors. The Privacy Policy, the Cookie Notice and other policies incorporated by reference apply where relevant. Separate Contributor Publishing and Monetization agreements govern paid contributors.
2. Acceptance; eligibility
Using the Platform signifies acceptance where legally effective; account registration requires an affirmative acceptance checkbox and a durable record of the accepted version.
Eligibility depends on how the Platform is used:
- Public visitors may access publicly available, age-appropriate content without registering.
- Registered readers must be at least 16 years of age, or any higher minimum age required by the law of their jurisdiction, and must confirm their age eligibility when registering. Registration is not available where local law does not permit it.
- Contributors must have the legal capacity to enter into the Contributor Publishing Agreement.
- Paid contributors must have the legal capacity to enter into the contributor subscription agreement.
- Participants in the earnings program must also meet the contractual, verification, tax and payment requirements of the Monetization and Earnings Policy.
- Any future programme for younger writers will operate only under separate terms and safeguards approved by GATHWAY.
A person who does not meet the applicable requirement must not register for or use the corresponding feature. GATHWAY may close an account that does not meet these eligibility requirements.
3. Accounts and security
Users must provide accurate registration information, protect credentials, and promptly report suspected compromise. Accounts are personal unless the Platform expressly permits organizational accounts. GATHWAY may require email confirmation, multi-factor verification or reauthentication for sensitive actions.
Registered readers aged 16 or 17 receive additional protections: their profiles are private by default; their personal information is not publicly disclosed unnecessarily; unsolicited messages from adult accounts are restricted; age-appropriate content controls apply; and their information is not used for personalized advertising or advertising profiling. Users must not attempt to circumvent these protections or to obtain personal information from younger users. An account holder who registered as 16 or 17 may confirm in their account settings once they are 18 or older.
4. Readers and contributor subscriptions
Reading is generally free unless a specific offering clearly states otherwise. Contributor membership is CAD $10 per month or CAD $120 payable annually; the annual plan is a lump-sum prepayment for a twelve-month term. Prices exclude applicable taxes unless stated otherwise; taxes, where GATHWAY is required to collect them, are calculated at checkout from the billing location and shown on the invoice and receipt. Payments are made to GATHWAY INC., the operator of the Platform, and processed by Stripe; card details are entered directly with Stripe and are not stored by GATHWAY. Billing frequency, renewal date, cancellation path and the applicable refund terms, set out in the Contributor Membership Refund Policy, are shown before purchase. Paying a fee does not guarantee publication, readership or earnings. Advertising and sponsorship purchases are governed by the Advertising and Sponsorship Policy and the advertiser- or sponsor-specific agreement; their invoices are issued by GATHWAY INC.
5. Automatic renewal and cancellation
Where recurring billing is offered, the checkout must clearly obtain any required consent to renewal and disclose the renewal interval and charge. Members may cancel renewal through an accessible account setting; cancellation stops future renewals, while access ordinarily continues through the paid term. Statutory cancellation and refund rights prevail. No unapproved refund policy is presumed.
Monthly memberships renew automatically each month, and annual memberships renew automatically every twelve months, at the price and on the terms disclosed at checkout, until cancelled. Members may cancel future renewals at any time through their account; cancellation generally takes effect at the end of the current paid billing period. Refunds remain subject to applicable consumer-protection laws and to any refund conditions disclosed before purchase. GATHWAY sends a reminder 30 days and again 7 days before each annual renewal, stating the renewal date, the expected amount and how to cancel, and provides other notices where required by applicable law; where the law requires a different notice period or procedure, that requirement applies. Refunds are governed by the Contributor Membership Refund Policy and applicable consumer-protection law.
If a renewal payment fails, GATHWAY notifies the member and allows a seven-day payment-recovery grace period, during which eligible membership benefits continue. If payment is not recovered within that period, the membership becomes inactive. The effect of membership inactivity on contributor earnings is described in the Monetization and Earnings Policy; validly accrued earnings are not forfeited solely because a membership expires, and works already published remain available under the Contributor Publishing Agreement.
6. Acceptable use
Users must not harass or threaten others, infringe rights, impersonate people, upload malware, scrape at scale contrary to applicable law, evade platform security, falsify professional credentials, fabricate citations or judgments, or manipulate readership metrics through bots, purchased traffic or coordinated deception. Legitimate sharing to attract genuine readers is permitted.
7. Publishing and third-party content
Articles and opinions are those of their respective authors unless explicitly designated as editorial statements of GATHWAY. Publication is subject to editorial review, verification and the Contributor Publishing Agreement. The Platform may contain links or advertising from third parties, subject to applicable disclosure practices.
8. No professional advice
Legal analysis and other professional content are for general information and discussion and do not by themselves establish a lawyer–client, physician–patient or other professional relationship. Readers should obtain independent advice tailored to their circumstances.
9. Moderation, suspension and appeals
GATHWAY may restrict, label, correct or remove material and restrict accounts to enforce its policies, comply with law, address security threats or prevent harm. Where practicable, affected users receive reasons and a reasonable review channel. Publishing archival rights do not prevent lawful removals or corrections.
10. Intellectual property
The Insight Docket brand, design and platform software belong to GATHWAY or its licensors. Contributors retain rights in original works subject to an express continuing licence agreed upon in the Contributor Publishing Agreement; Platform visitors receive only limited personal-use access.
11. Disclaimers and limitation of liability
To the extent permitted by applicable law, the Platform is offered without guarantees of uninterrupted access, publication acceptance, audience size or earnings. Nothing excludes or limits rights, warranties, remedies or liability that cannot lawfully be excluded, including liability for fraud or wilful misconduct. A monetary liability cap, if adopted, requires separate legal approval and clear drafting.
12. Governing law; complaints; amendments
The laws of Ontario and applicable federal Canadian law govern these Terms, subject to mandatory consumer and data-protection rules in other jurisdictions. Users may contact legal@gathway.app. Material changes should be announced with advance notice where required, and new consent obtained where required; maintain versioned acceptance records.
